California NEMT Regulatory Requirements
1.What Is a TCP Permit, and Why Does It Matter for Insurance?
TCP stands for Transportation Charter-Party carrier. It’s a permit issued by the California Public Utilities Commission (CPUC). The state agency that regulates companies transporting passengers for a fee in California.
If your NEMT business drives patients to appointments for compensation, you most likely need a TCP permit to legally operate in California. Think of it as your state-level license to transport passengers, separate from your regular business license or DMV vehicle registration.
Why this matters for insurance: the CPUC won’t issue or keep a TCP permit active unless you have the right amount of liability insurance on file with them. In other words, getting properly insured isn’t just good practice , it’s a legal requirement to keep your operating authority valid.
2. Insurance minimums are set by CPUC General Order 115-G and scale by vehicle seating capacity:

3. TCP Insurance Filing Requirement
All TCP carriers must have public liability and property damage insurance electronically filed with the CPUC before operating authority is issued, via the Transportation Carrier Portal (TCPortal). Coverage must remain continuously in effect , a lapse can trigger suspension or revocation of operating authority if not corrected within 90 days.

4. Workers’ Compensation, No Employee-Count Threshold
Under California Labor Code Section 3700, any employer with even one employee (full-time, part-time, or temporary) must carry workers’ compensation insurance. There is no minimum employee count exemption.

5. DHCS Medi-Cal NEMT Enrollment, Vehicle Safety Inspection
NEMT providers billing Medi-Cal must be enrolled with the Department of Health Care Services (DHCS). As of March 27, 2025, applicants must submit a Vehicle Safety Systems Inspection (VSSI) certificate issued by the Bureau of Automotive Repair (replacing the older DCA brake-and-light certificate).

6. DHCS Enrollment Fee
